Terms of Service

1. Agreement

These Terms of Service ("Terms") are an agreement between you and blueobsidian io LLC ("we", "us"), which operates Pick Local. By using the site, creating an owner account, claiming a listing, or buying a plan, you agree to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, please do not use the site.

You must be at least 18 years old, or the age of majority where you live, to create an account or buy a plan.

2. What the service is

Pick Local is a free public directory of local businesses, organized by state, town and category. Visitors can search and browse listings, deals, jobs, business updates and articles. Business owners can claim and manage their listing, post deals, jobs and updates, and buy optional paid plans that give their listing more visibility.

Listings are built from publicly available business information and from what owners tell us. We work to keep them accurate, but we do not verify every detail, and we do not endorse, recommend or guarantee any business, product, price or service shown on the site.

3. For visitors

Any arrangement you make with a business you find here is between you and that business. Check licenses, insurance, reviews, prices and terms directly with the business before you hire or buy. We are not a party to those transactions and are not responsible for them.

Ratings and review counts shown on listings come from public sources and may not be current.

4. Owner accounts and claims

To manage a listing you need an owner account. Give accurate information, keep your password private, and tell us if you think someone else has used your account. You are responsible for what happens under your account.

You may only claim a business you own or are authorized to represent. We may ask for proof, review or decline a claim, and remove access if a claim turns out to be wrong. When two people claim the same business we may keep the current owner in place while we review both claims.

5. Content you post

You keep ownership of the text, photos, deals, jobs and updates you add ("your content"). You give us a worldwide, non-exclusive, royalty-free license to host, display, format, translate into summaries, and share your content on the site and in materials that promote your listing or the directory, for as long as it is on the site.

You confirm that you have the right to post your content and that it is accurate, lawful and not misleading. Deals must be honored as written, and job posts must describe real openings and follow employment law.

Deals, jobs and updates are reviewed before they go live. We may edit for formatting, decline, or remove content at our discretion.

6. Acceptable use

You agree not to:

• post false, misleading, defamatory, hateful, or illegal content, or content that infringes anyone's rights;
• impersonate a business or person, or claim a listing you are not authorized to manage;
• scrape, copy in bulk, or resell directory data, or use automated tools that put unreasonable load on the site;
• try to get around security, access accounts or areas that are not yours, or interfere with the site working;
• use the site to send spam or unsolicited messages to businesses or visitors.

7. Paid plans and billing

Listing on the directory and claiming a listing are free. Paid plans (such as Featured, Pro and Premium) are monthly subscriptions at the prices shown on the plans page when you buy. Payments are processed by Stripe; we do not see or store your full card number.

Plans renew automatically each month until cancelled. You can cancel at any time from your owner dashboard; the plan stays active until the end of the period you paid for, and then your listing returns to the free plan. Except where the law requires otherwise, payments are not refundable for partial months.

A plan changes how prominently a listing is shown in the places the plans page describes. It does not buy a review, a rating, or a position among free listings, and we do not promise any number of views, calls or customers.

We may change plan prices or perks with at least 30 days' notice by email before your next renewal.

8. Automated content

Some listing text, summaries and articles are written or drafted with the help of AI tools and checked against the facts we hold. Owner and staff edits always take priority over automated text. Articles on our blog are general information, not professional, legal or financial advice.

9. Our content and brand

The site, its design, software, articles, illustrations and the Pick Local name and logo belong to us or our licensors. You may share links to the site and quote small parts with attribution; you may not copy the site or its data for a competing directory.

10. Corrections and removal

If a listing about your business is wrong, claim it and edit it, or contact us at hello@ezorders.shop. A business that does not want to be listed or contacted can ask us to remove the listing or mark it do not contact, and we will honor that request.

If you believe something on the site infringes your copyright, send us the work, where it appears, and your contact details, and we will review and act on the notice.

11. Suspension and closing an account

You may close your owner account at any time by contacting us. We may suspend or close accounts, remove listings or content, or refuse service if these Terms are broken or to protect visitors, owners or the site. Sections that by their nature should survive, such as licenses already granted, disclaimers and limits of liability, survive termination.

12. Disclaimers

The site is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise the site will be uninterrupted, error free or that listings are complete or current.

13. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the site or from any business you find on it. Our total liability for any claim relating to the site is limited to the greater of the amount you paid us in the 12 months before the claim or one hundred US dollars.

14. Indemnity

If you are an owner, you agree to defend and hold us harmless from claims arising from your content, your business, your deals and job posts, or your breach of these Terms.

15. Governing law

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law rules. Disputes will be heard in the state or federal courts located in Wayne County, Michigan, and you and we consent to that jurisdiction, except where the law where you live gives you the right to bring a claim locally.

16. Changes to these Terms

We may update these Terms. The date at the top shows the latest version. If a change is significant we will tell owners by email or on the dashboard before it takes effect. Using the site after a change means you accept the new Terms.
